Uber Biz is operated by Envion PTY LTD (“the Company”), operating under the laws of the Republic of South Africa, expressly disclaims all liability for any personal injury, death, property damage, loss, theft, or destruction of belongings sustained by passengers, third parties, or service providers during transportation services facilitated through the Company’s digital platform. The Company functions exclusively as an intermediary technology provider, connecting users with independent third-party transport service providers (“Transport Operators”). The Company does not own, operate, manage, or control Transport Operators, their vehicles, drivers, or conduct, and assumes no responsibility for their compliance with South African transport regulations, including but not limited to the National Land Transport Act (No. 5 of 2009). - Exclusion of Liability
To the fullest extent permissible under South African law, including the Consumer Protection Act (No. 68 of 2008), the Company shall not be held liable for:- Any acts, omissions, negligence, or wilful misconduct by Transport Operators, including delays, accidents, unsafe vehicle conditions, or violations of traffic laws.
- Loss or damage to personal belongings left unattended in vehicles.
- Indirect, incidental, punitive, or consequential damages arising from the use of the platform or reliance on Transport Operators’ services.
- No Affiliation or Endorsement
The Company is not affiliated with, endorsed by, or in a legal partnership with any Transport Operator. Transport Operators are independent entities solely responsible for their licensing, insurance (including mandatory passenger liability insurance as per South African law), vehicle roadworthiness, and adherence to all applicable regulations. - User Responsibility
Passengers engage Transport Operators at their own risk. Users are advised to:- Verify the Transport Operator’s valid operating license, insurance coverage, and vehicle condition prior to boarding.
- Secure personal belongings during transit.
- Report incidents directly to the Transport Operator and relevant authorities (e.g., SAPS) where necessary.
- Governing Law & Jurisdiction
This Disclaimer shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from services facilitated through the Company’s platform shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa. - Force Majeure
The Company shall not be liable for failures or delays in platform functionality or service delivery caused by events beyond its reasonable control, including but not limited to network outages, natural disasters, or regulatory interventions.
By using the Uber Biz platform, users expressly acknowledge and agree to the terms of this Disclaimer.
