Terms and Conditions

1. Acceptance of Terms

By accessing or using this service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease using the service.

2. Service Description

This platform facilitates communication between commuters and transport service providers. It operates on a subscription-based model, providing transport providers with access to a wider range of commuters and opportunities for bookings.

3. Subscription and Payments

3.1. Transport service providers are required to pay a monthly subscription fee of R1500, per vehicle, which equates to R50 per day or less.
3.2. All subscriptions are non-refundable. Due to the digital nature of the service, no returns or refunds will be issued under any circumstances.
3.3. Failure to pay the subscription fee will result in immediate suspension of access to the service.

4. Prohibited Conduct and Strike System

To maintain the integrity of the service, the following rules apply:

4.1. Strike System:

  • 4.1.1. Forwarding Messages: Forwarding any service-related messages is strictly prohibited. Each violation will result in 1 strike.

  • 4.1.2. Interfering with Reactions: Constantly interfering when there are more than 4 reactions (e.g., reacting as the 5th reactor) will result in up to 3 warnings. Subsequent violations will result in 1 strike.

  • 4.1.3. Confirming Unavailable Services: Confirming a service while being unavailable or unable to meet the commuter’s requested pick-up time (within a maximum of 10 minutes) is prohibited. Drivers who attempt to “squeeze in” a service while occupied will receive 1 severe warning. Repeated violations will result in 1 strike.

4.2. Consequences of Strikes:

  • Accumulating 3 strikes will result in permanent banning from the platform.

  • Any remaining subscription balance will be forfeited without refund.

5. Logs and Monitoring

5.1. The service maintains logs to monitor user activity and prevent abuse.
5.2. Users who violate these terms will be identified through these logs and subject to the strike system outlined above.
5.3. Company Subscriptions: If a company’s subscription covers more than one vehicle, it is the sole responsibility of the owner/employer to ensure that their employees (drivers) adhere to these rules. Uber Biz will not be held liable if a single subscription is banned due to the actions of one driver.

6. Commuter and Provider Responsibilities

6.1. Transport Providers:

  • Must confirm availability only when they are reasonably near the requested pick-up location and able to meet the commuter within 10 minutes.

  • Must not confirm services if they are already occupied or unable to fulfill the request.

6.2. Commuters:

  • Must provide accurate pick-up and drop-off details.

  • Are expected to report drivers who take longer than 10 minutes to arrive. However, commuters are expected to act in a reasonable, considerate, and fair manner. For example, a driver arriving 11 minutes late should not be reported, as this falls within a reasonable margin.

7. Employer Responsibility

7.1. Company owners or employers who subscribe to the service for multiple vehicles are solely responsible for the actions and infractions of their drivers.
7.2. Any violations committed by drivers under a company subscription will be attributed to the company, and the subscription may be subject to penalties, including banning, as outlined in the strike system.

8. Limitation of Liability

8.1. The service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
8.2. The platform is not liable for any direct, indirect, or consequential damages arising from the use of the service.

9. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the South African courts.

10. Amendments

We reserve the right to amend these Terms and Conditions at any time. Continued use of the service after such changes constitutes acceptance of the revised terms.
